By accessing or using InvisMark's invisible watermarking service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service, including any content, functionality, and services offered on or through invismark.com.

2. Description of Service

InvisMark provides an AI-powered invisible watermarking service that allows users to:

• Embed invisible watermarks in images and videos
• Protect digital content from unauthorized use
• Detect and verify watermarks in content
• Track content distribution and usage

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

3.2 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or illegal activities.

4. Subscription Plans and Payment

4.1 Plans

We offer the following subscription plans:

• Starter: $19/month or $199/year - 200 credits per month
• Professional: $49/month or $499/year - 600 credits per month
• Enterprise: $99/month or $999/year - 1,500 credits per month

4.2 Credit System

• Each image watermark consumes 1 credit
• Video watermarks consume 5-20 credits based on length and resolution
• Credits reset monthly and do not roll over
• Additional credits may be purchased separately

4.3 Billing

• Subscriptions are billed in advance on a monthly or annual basis
• Payment processing is handled securely by Stripe
• Prices are subject to change with 30 days notice
• All fees are exclusive of taxes unless stated otherwise

4.4 Auto-Renewal

Subscriptions automatically renew unless cancelled before the renewal date. You can cancel anytime through your account settings.

5. User Content

5.1 Ownership

You retain all rights to content you upload to the Service. By uploading content, you grant InvisMark a limited, non-exclusive license to process your content solely for providing the watermarking service.

5.2 Content Restrictions

You agree not to upload content that:

• Infringes on intellectual property rights
• Contains illegal, harmful, or offensive material
• Violates privacy rights of others
• Contains malware or harmful code
• Is fraudulent or deceptive

5.3 Content Removal

We reserve the right to remove content that violates these Terms or applicable laws. Uploaded content is automatically deleted from our servers 30 days after processing.

6. Intellectual Property

6.1 InvisMark Property

The Service, including its original content, features, and functionality, is owned by InvisMark and protected by international copyright, trademark, and other intellectual property laws.

6.2 Watermarking Technology

Our proprietary AI watermarking technology and algorithms remain our exclusive property. You may not reverse engineer, decompile, or attempt to extract our technology.

7. Prohibited Uses

You agree not to:

• Use the Service for any illegal purpose
• Transmit viruses or malicious code
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Use automated systems or software to extract data
• Resell or redistribute the Service without permission
• Circumvent usage limits or restrictions
• Impersonate others or provide false information

8. Disclaimers and Limitations

8.1 Service Availability

The Service is provided "as is" and "as available." We do not guarantee uninterrupted, secure, or error-free operation. We may modify or discontinue features without notice.

8.2 Watermark Effectiveness

While our technology is designed to be robust, we cannot guarantee that watermarks will be completely unremovable or always detectable after significant content manipulation.

8.3 Limitation of Liability

To the fullest extent permitted by law, InvisMark shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising from your use of the Service.

9. Indemnification

You agree to indemnify and hold harmless InvisMark, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.

11. Termination

We may terminate or suspend your account immediately, without prior notice, for:

• Breach of these Terms
• Fraudulent or illegal activities
• Non-payment of fees
• Providing false information

Upon termination, your right to use the Service will cease immediately. You may terminate your account at any time through your account settings.

12. Dispute Resolution

12.1 Informal Resolution

We prefer to resolve disputes informally. Please contact us at support@invismark.com before initiating any formal proceedings.

12.2 Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict of law principles.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or through the Service. Your continued use after changes constitutes acceptance of the new Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on the Service, constitute the entire agreement between you and InvisMark.
